3. Products

Genesis Exotics supplies fresh fruits, vegetables, herbs and other produce sourced from approved growers and suppliers worldwide.

All products are supplied subject to seasonal availability.

Images, descriptions and specifications shown on our website or marketing materials are for illustrative purposes only.

4. Orders

Orders may be placed by email, telephone or other agreed communication channels.

An order becomes binding only when accepted by Genesis Exotics.

We reserve the right to refuse or cancel orders at our discretion, including where products are unavailable or pricing errors have occurred.

5. Pricing

All prices are subject to confirmation at the time of order.

Prices may change without prior notice due to:

  • Seasonal market conditions
  • Exchange rate fluctuations
  • Freight costs
  • Supply chain disruptions
  • Government duties and taxes

Unless otherwise stated, prices exclude VAT and any applicable duties.

6. Payment Terms

Payment terms shall be agreed between Genesis Exotics and the Customer.

Unless otherwise agreed in writing:

  • Payment is due within 30 days of invoice date.
  • Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Genesis Exotics reserves the right to suspend future deliveries until outstanding balances are settled.

7. Delivery

Delivery dates are estimates only.

While every effort is made to deliver products on time, Genesis Exotics shall not be liable for delays caused by:

  • Weather conditions
  • Customs inspections
  • Transportation disruptions
  • Supplier delays
  • Force majeure events

Risk in the products passes to the Customer upon delivery.

8. Inspection and Claims

Customers must inspect products immediately upon delivery.

Any shortages, damage, quality concerns or discrepancies must be reported within:

  • 24 hours of delivery for fresh produce
  • 48 hours for administrative discrepancies

Failure to notify us within this period may result in claims being rejected.

Supporting photographs and relevant documentation may be requested.

9. Fresh Produce Quality

Fresh produce is a perishable product.

Natural variations in:

  • Size
  • Shape
  • Colour
  • Weight
  • Appearance

do not constitute defects where products remain commercially acceptable.

Genesis Exotics will take all reasonable steps to ensure products meet agreed specifications at the time of dispatch.

10. Product Availability

Product availability may vary due to seasonal and agricultural conditions.

Genesis Exotics reserves the right to:

  • Substitute equivalent products
  • Amend quantities
  • Modify delivery schedules

where necessary.

Customers will be informed where practical.

11. Retention of Title

Ownership of products remains with Genesis Exotics until full payment has been received.

Until ownership transfers:

  • Products must be stored separately where possible.
  • Customers must not pledge or charge products as security.
  • Genesis Exotics may recover unpaid goods where legally permitted.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Loss of profit
  • Loss of business
  • Indirect or consequential losses
  • Loss arising from delays beyond our reasonable control

Our total liability shall not exceed the value of the products supplied under the relevant order.

Nothing in these Terms excludes liability for death, personal injury, fraud or any liability that cannot be excluded under applicable law.

13. Force Majeure

Genesis Exotics shall not be liable for failure or delay in performance caused by events beyond reasonable control, including:

  • Natural disasters
  • Floods
  • Droughts
  • Pandemics
  • Labour disputes
  • Transport disruptions
  • Government restrictions
  • War or civil unrest

14. Intellectual Property

All website content, logos, branding, images and marketing materials remain the property of Genesis Exotics unless otherwise stated.

No content may be reproduced without prior written permission.

15. Website Use

Users agree not to:

  • Misuse the website
  • Attempt unauthorised access
  • Introduce malicious software
